| 1. Heim L.P. warrants each new Heim press and
parts thereof to the first owner-operator to be free from defects
in material and workmanship under normal use and service for
a period of one year.
2. The obligation of Heim L.P. under this warranty is limited
to making good at its factory, such parts which, within one
year after delivery to the first one year owner-operator,
shall be returned with transportation charges prepaid, and
which its examination shall disclose to its satisfaction to
have been thus defective in material or workmanship.
3. No claims will be allowed for parts which have been subjected
to abuse or neglect, faulty installation, or where failure
has been caused by accident.
4. The obligations under this warranty are void unless factory
approved parts are used and proper installation procedure
is followed by the first owner-operator or his Agents. The
recommendations and specifications contained in HEIM L.P.
INSTRUCTION OPERATION MANUAL must be followed.
5. Heim L.P. reserves the right to improve its product through
changes in design or material without being obligated to incorporate
such changes in presses of prior manufacture.

6. Heim L.P. accepts no responsibility for collateral
liability through the failure of any press or parts. Collateral
liability shall include, but not be limited to, damage
to materials, loss of time, cost or rental of replacement, freight
charges, and damage to other machines.
7. Heim L.P. neither assumes nor authorizes any other person
to assume for Heim L.P. any liability or expense in the replacing
of parts or servicing of presses within the warranty period,
except when such expense be authorized in advance and in writing
by Heim L.P.
8. This warranty shall be void unless the first owner-operator,
within ten days of delivery of such press to him or it, shall
complete the attached Warranty Activating Card and mail it
to Heim L.P.
9. This warranty is in lieu of all other warranties, statutory,
express or implied, and of all other obligations or liabilities
on the part of Heim L.P. and does not extend to other trade
accessories, inasmuch as they are usually warranted separately
by respective manufacturers.
10. All equipment is sold without operator safeguards to
the point(s) of operation. Customer takes full responsibility
for insuring that equipment is properly guarded, used and
maintained (including but not limited to fences, point of
operation devices, etc.) in accordance with OSHA regulations
governing the care, operation, and use of such equipment,
as they may be amended from time to time. |
